At a private GOP Conference meeting, Goodlatte tried to calm fellow Republicans who were incensed to learn that some of his aides helped craft Trump's immigration directive without telling him or GOP leaders about it. Publicly, Goodlatte and his staff refused to answer further questions about the arrangement, which was first reported by POLITICO on Monday. Democrats, meanwhile, almost immediately began raising ethical concerns about nondisclosure agreements signed by the Judiciary aides — and questioned whether such work infringes on separation of powers.
Asked about the matter by Rep. Bill Flores (R-Texas) at the closed-door GOP session, Goodlatte said he gave his staff permission to advise the transition team. A committee spokeswoman, however, said Monday he did not know about the executive order specifically. On Tuesday, panel aides refused to say how specifically the staffers contributed to the executive order, why they did not tell Republican leaders about their work and whether they took a leave of absence from their official duties to help the transition team. Goodlatte told lawmakers during the conference meeting that his aides merely gave policy advice and did not know anything about the timing of the executive order or its final contents. “To be clear, while they gave advice to the new administration, they did not have decision-making authority on the policy,” Goodlatte said in a statement. “The final decision was made at the highest levels of the Trump administration… My staff had no control of the language contained in the President’s executive order, the timing of the announcement, the rollout and subsequent implementation, and the coordination with Congress.” Goodlatte's comments appear to conflict with those made by the White House. A senior administration official told reporters on Sunday that “Republicans on Capitol Hill wrote" the order and "the top drafters of this were the top immigration experts on Capitol Hill.” In a letter Tuesday to the Office of Congressional Ethics, an outside ethics group called the Campaign for Accountability asked the independent watchdog to investigate whether the arrangement broke federal laws or House rules. “Employees of the United States House of Representatives are duty-bound to serve Members of Congress and the Americans who elected them," the group's acting executive director, Daniel Stevens, said in a statement. "It appears that these House staffers surreptitiously worked on issues for the President-elect, and perhaps later the White House, without even telling the members for whom they worked." Senior Democrats and lawmakers on the Judiciary panel, meanwhile, began raising ethical concerns amid the confusion. Of particular concern are confidentiality agreements the staffers signed at the request of Trump’s transition operation. “I'm very concerned that Judiciary Committee Republicans may have worked to write President Trump's illegal Muslim ban and agreed to conceal their role through a nondisclosure agreement,” said Judiciary Committee member Eric Swalwell (D-Calif.) “Congress is supposed to be a transparent check on the president. Not a shadowy accomplice to un-American policy.” House Minority Whip Steny Hoyer (D-Md.) was dismayed House GOP staffers were advising Trump officials at all. “We are an independent [body]; we’re not an arm of the administration,” the Maryland Democrat told reporters. The news “ought to be very concerning to every member of the Congress of the United States, Republican or Democrat, that you’ve got staff members doing something for the administration without telling their principals.” Republicans, for the most part, seemed eager to move past the drama. Department of Homeland Security officials said Tuesday that Trump's order as first issued also applied to green card holders, but they have now been granted a broad waiver, except in cases of particular suspicion. At the press conference, the president-elect refused to take a question from CNN correspondent Jim Acosta, who shouted out to him to answer his question since he was attacking his news organization. After his inauguration, Trump has continued blasting CNN as “fake news." Since then, Conway, Spicer, Chief of Staff Reince Priebus and even Vice President Mike Pence have made the rounds on the major Sunday shows but, notably, CNN’s “State of the Union" has been cut out. “State of the Union” anchor Jake Tapper said on his show and via Twitter that the White House has declined his invitations to appear. "We invited the Trump White House to offer us a guest to provide clarity and an explanation of what the president just did, especially given so much confusion, even within its own government by those who are supposed to carry out this order,” Tapper said on Sunday as he introduced a segment about the Executive Order banning visitors from some countries and putting a hold on the United States’ refugee policy. "The Trump white house declined our invitation.” Tapper said something similar the previous Sunday. Last week, New York Magazine reported that Trump’s feud with CNN has roots in his relationship with its president, Jeff Zucker, a former NBC president who brought Trump's “The Apprentice” television show to the network. Trump, the magazine reported, has told White House staffers that he feels personally betrayed by Zucker and that Zucker should be programming CNN more favorably toward him because of their long relationship. In an interview with New York Magazine, Zucker said he’s not worried about getting access to Trump. “I think the era of access journalism as we’ve known it is over,” Zucker said. “I think our credibility is higher than ever, and our viewership is higher than ever, and our reporting is as strong as ever.” “One of the things I think this administration hasn’t figured out yet is that there’s only one television network that is seen in Beijing, Moscow, Seoul, Tokyo, Pyongyang, Baghdad, Tehran, and Damascus — and that’s CNN,” he noted. Part of the effort to ice out CNN may be related to ratings. CNN “Reliable Sources” host Brian Stelter wrote in one of his recent newsletters that an aide in “Trumpworld” told him that his ratings would likely be hurt "because no Trump administration officials had agreed to be interviewed.” Stelter said in that newsletter that his ratings were in fact his highest since last November's election coverage at 1.3 million viewers. It’s hard to tell whether “State of the Union” ratings have been affected by the lack of Trump officials, considering that it's less than two weeks since the Inauguration. While far behind the broadcast shows and “Fox & Friends” on cable news, the last two weeks of “State of the Union” have seen higher ratings than on Jan. 8, the last time a Trump official appeared. They've also won the demo (the key age group advertisers use) over the last two weeks, and last Sunday the show had 1.25 million viewers during the 9 a.m. broadcast, and 1.42 million viewers in the noon rebroadcast. It's not unusual for a White House to tangle with certain outlets. A former official in President Barack Obama's office acknowledged that they had their "battles with Fox," and that there may have been some times where "we sent people on other networks and not on Fox." But as a general rule, the official said, officials would go on the network. "I think, in my hazy recollection is it would be unusual to do all [the networks] except one. What drives that is sometimes amount of time available to the person doing them," the official said. "If they are stiffing CNN intentionally, that is different than what normally happens."
